Welcome to CarScan. These Terms of Use (“Terms”) govern your use of our Facebook App (“App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using the App, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

CarScan provides a platform for car dealerships to post listings of cars for sale and for users to search and browse these listings. The App aggregates data from participating dealerships and presents it to users in a searchable format.

3. User Responsibilities

• You agree to use the App only for lawful purposes and in accordance with these Terms.
• You shall not use the App in a way that could harm or impair its functionality or interfere with other users’ use of the App.
• You are responsible for ensuring that any information you provide to the App is accurate and up to date.

4. Dealer Responsibilities

• If you are a dealership, you agree to provide accurate and truthful information about your car listings.
• You consent to CarScan collecting and displaying your car listings on the App.
• You are responsible for responding to inquiries from potential buyers generated through the App.

5. Intellectual Property Rights

• All content and materials on the App, including text, graphics, logos, and software, are the property of CarScan or its licensors and are protected by copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, or sell any content from the App without prior written consent from CarScan.

6. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. CarScan makes no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, materials, or products included on the App.

7. Limitation of Liability

In no event shall CarScan be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability to you for any claim arising from your use of the App shall not exceed the amount paid by you, if any, for accessing the App.

8. Indemnification

You agree to indemnify and hold CarScan, its affiliates, and their respective officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the App.

9. Changes to the Terms

CarScan reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Israel without regard to its conflict of law principles.
